FlixBus delay compensation: your rights under EU Regulation 181/2011
Coach passengers in the EU have fewer rights than rail or air passengers, but they are not nothing. Regulation (EU) No 181/2011 sets minimum rights on scheduled services, and FlixBus's own terms add a little on top. This guide explains, threshold by threshold, what you can claim when your bus is late, and how to make the claim stick.
1. Which trips are covered
- Scheduled services (regular lines with a timetable), which is what FlixBus, FlixTrain's bus replacements, National Express and Vy express coaches are.
- Distance matters. The refund/re-routing and 50% rules (Article 19) apply only when the scheduled distance of the service is 250 km or more. Shorter services get the information and non-discrimination rights but not the money.
- Where. Departure or arrival in an EU member state. The UK kept the regulation in domestic law after Brexit (retained EU law), so National Express and FlixBus UK services are covered on the same terms.
- Who is liable. The carrier named on the ticket. FlixBus sells tickets for services operated by partner bus companies, but Flix is the contracting carrier and handles the claims.
2. The thresholds
| Situation | Condition | What you are owed |
|---|---|---|
| Cancellation, or departure delayed > 120 min | Service ≥ 250 km | Choice of (a) re-routing to the destination at the earliest opportunity at no extra cost, or (b) full refund within 14 days, plus a free return to the first departure point if needed. |
| Carrier does not offer that choice | Service ≥ 250 km | Refund plus 50% of the ticket price, paid within one month of the claim. |
| Departure delayed > 90 min, or cancelled | Service ≥ 250 km and scheduled duration > 3 h | Snacks, meals or refreshments in reasonable relation to the waiting time; hotel (max €80/night, 2 nights) plus transport to it when an overnight stay is needed. Not owed when the delay is due to severe weather or natural disaster. |
| Bus becomes inoperable during the trip | Any distance | Continuation with another vehicle, or transport to a suitable waiting point from which the journey can continue. |
| Delay at departure from a terminal | Any | Information on the situation and the estimated departure time as soon as possible, and in any event no later than 30 minutes after the scheduled departure. |
Note what is not there: unlike trains (Regulation 2021/782) or flights (261/2004), there is no fixed compensation for arriving late when the bus left on time. A FlixBus that departs 10 minutes late and arrives three hours late owes you nothing under the regulation. That is exactly why your evidence should focus on the departure delay.
3. What FlixBus adds on top
Flix's general terms go slightly beyond the regulation in two ways: rebooking is usually offered through the app for free when a trip is cancelled by Flix, and customer service often grants vouchers for long delays as goodwill. A voucher is not a refund. If you meet the Article 19 conditions you may insist on money, and you do not have to accept a voucher in place of the 50% top-up.
4. How to claim, step by step
- Document the departure delay while it happens. Screenshot the FlixBus app and the "Track my bus" page showing the scheduled and expected departure times, and note the actual departure time. Our delay certificate captures what the public tracking feed reported for your ride, with the scheduled and actual times per stop, and can be issued for any ride we observed.
- Ask for the choice at the terminal. If staff do not offer re-routing or refund, ask explicitly, and note the time and the name or description of the person you spoke to. The 50% top-up depends on the carrier failing to offer the choice.
- Keep receipts for meals, hotel and alternative transport you had to pay for yourself.
- File the complaint with the carrier first, within three months of the trip (Article 27): through the FlixBus help centre form, quoting the booking number, the service distance, the departure delay in minutes and the articles you rely on (19 and 21 of Regulation 181/2011). Attach the evidence. The carrier must acknowledge within one month and give a final answer within three.
- Escalate if the answer is unsatisfactory: to the national enforcement body of the country of departure (in Germany the Eisenbahn-Bundesamt handles bus passenger rights; in France the DGCCRF; in Poland the Główny Inspektorat Transportu Drogowego; in the UK the Bus Users UK/Driver and Vehicle Standards Agency route). The European Consumer Centre network (ECC-Net) helps with cross-border claims for free.
5. Template complaint
Booking [number], service [line] from [origin] to [destination] on [date], scheduled departure [time]. The bus departed at [time], a delay of [N] minutes on a service of [km] km. At the terminal no choice between re-routing and refund was offered. Under Articles 19(1) and 19(2) of Regulation (EU) No 181/2011 I request a refund of the ticket price of [€] plus compensation of 50% of the ticket price, and under Article 21 reimbursement of [meals/hotel] of [€] (receipts attached). Evidence: app screenshots and the attached delay certificate. Please reply within one month.
6. Realistic expectations
Most delays we record are well below the thresholds. Across the network the typical (median) delay is a few minutes and only a small share of rides leave more than two hours late; check the specific line or route page before you plan on a refund. What the data is very good for is the opposite case: showing a pattern. If a line is late on most days, a complaint that cites the line's published on-time rate is harder to brush off.
Frequently asked questions
Does FlixBus pay compensation for a late arrival?
Not under EU law. Regulation 181/2011 compensates cancellations and departure delays over 120 minutes on services of 250 km or more (refund plus 50% if the carrier did not offer a refund/re-routing choice). Arrival delay alone gives no fixed compensation, though you can claim costs it caused in some countries under general contract law.
How long do I have to claim?
Submit the complaint to the carrier within three months of the date the service was or should have been performed. The carrier has one month to acknowledge and three months to give a final reply.
My FlixBus was cancelled the day before. What am I owed?
On a service of 250 km or more: the choice of re-routing at the earliest opportunity or a full refund within 14 days. If the choice is not offered, 50% of the fare on top. Flix usually offers free rebooking in the app; you can still insist on the refund.
Is a Bustempo delay certificate accepted as proof?
It is independent evidence of what the operator's public tracking feed reported for the ride, with per-stop scheduled and actual times and a verification link. It is not an official carrier statement; whether it is accepted is up to the carrier or enforcement body, but it is far better than nothing and carriers rarely dispute their own feed.
